When a person wants to get divorced it can become quite tempting to try and record the phone call of a spouse in order to catch them saying something that will get them in trouble, but actually recording phone call or getting someone on tape without their permission presents a difficult legal problem because it’s not always legal to do so and in many circumstances there is the necessity of the person recording to make it known to the person who is to be recorded that a taping will occur and this usually defeats the purpose of creating a recording in the first place.
